Les présentes Conditions Générales de Vente régissent les ventes conclues sur le site internet de White Star Watch SA, société suisse active dans le domaine de l’horlogerie et de la bijouterie-joaillerie, sise à la Rue des Crêtets 87, 2300 La Chaux-de-Fonds, Suisse.

2. Champ d’application
Les présentes Conditions Générales de Vente s’appliquent exclusivement aux ventes de produits White Star conclues avec des clients finaux consommateurs, par l’intermédiaire du site internet officiel de White Star ou de tout autre canal de vente directement géré par White Star.
En passant commande, le client reconnaît avoir pris connaissance des présentes Conditions Générales de Vente et les accepter sans réserve.
La version applicable est celle en vigueur au moment de la validation de la commande.
3. Produits
Les produits proposés à la vente sont décrits et présentés avec le plus grand soin.
Les photographies, vidéos, rendus 3D, illustrations ou visuels figurant sur le site sont fournis à titre indicatif. De légères différences peuvent exister entre les visuels et le produit livré, notamment en raison des effets de lumière, de rendu d’écran, de matériaux, de finitions, de bracelets, de textures ou d’assemblage.
Les caractéristiques essentielles des produits sont indiquées sur les pages concernées, notamment le modèle, les matériaux, les dimensions, le mouvement, l’étanchéité, les bracelets, les finitions et les éventuelles options disponibles.
White Star se réserve le droit d’apporter à ses produits toute amélioration technique ou esthétique ne modifiant pas substantiellement les caractéristiques essentielles du produit commandé.
4. Prix
Les prix sont indiqués en francs suisses CHF ou la monnaie locale correspondant au pays de l’acheteur.
Pour les ventes livrées en Suisse, les prix incluent la TVA suisse lorsque celle-ci est applicable.
Sauf indication contraire, les prix ne comprennent pas les droits de douane, taxes d’importation, frais administratifs, frais bancaires, frais de change ou autres frais applicables dans le pays de livraison.
Pour les livraisons hors de Suisse, le client est seul responsable du paiement des éventuels droits de douane, taxes d’importation, TVA locale ou autres frais exigés par les autorités du pays de destination.
White Star se réserve le droit de modifier ses prix à tout moment. Le prix applicable est celui affiché au moment de la validation de la commande.
5. Commande
Le client passe commande sur le site internet de White Star en sélectionnant le ou les produits souhaités, en renseignant les informations demandées et en validant le paiement.
Avant validation définitive, le client doit vérifier l’exactitude de sa commande, notamment le modèle choisi, les options, l’adresse de livraison, les coordonnées de contact et les informations de facturation.
La commande devient définitive après confirmation du paiement et acceptation de celle-ci par White Star.
White Star se réserve le droit de refuser ou d’annuler toute commande en cas de suspicion de fraude, d’erreur manifeste de prix, d’indisponibilité du produit, de litige antérieur avec le client, d’informations incomplètes ou erronées, ou pour tout autre motif légitime.
6. Paiement
Le paiement s’effectue selon les moyens proposés sur le site internet au moment de la commande, notamment par carte bancaire, virement bancaire ou toute autre solution de paiement disponible.
La commande ne sera traitée qu’après réception complète du paiement, sauf accord écrit contraire de White Star.
En cas de paiement par virement bancaire, la commande ne sera confirmée qu’après réception effective des fond.
Tous les frais bancaires, frais de change ou frais liés au moyen de paiement utilisé sont à la charge du client.
7. Disponibilité et délais de livraison
White Star s’efforce d’indiquer les disponibilités et délais de livraison avec la plus grande précision possible.
Les délais de livraison sont communiqués à titre indicatif, sauf engagement écrit contraire de White Star. Certains produits peuvent nécessiter un délai de préparation, d’assemblage, de contrôle qualité ou de mise à disposition.
White Star ne saurait être tenue responsable des retards dus à des circonstances indépendantes de sa volonté, notamment retards de transport, formalités douanières, grèves, difficultés d’approvisionnement, perturbations logistiques, événements sanitaires, décisions administratives, cas de force majeure ou tout autre événement échappant raisonnablement à son contrôle.
8. Livraison
Les produits sont livrés à l’adresse indiquée par le client lors de la commande.
Le client est responsable de l’exactitude et de la complétude des informations de livraison transmises. White Star ne pourra être tenue responsable d’un retard, d’une impossibilité de livraison ou de frais supplémentaires résultant d’une adresse erronée, incomplète ou imprécise.
Les frais de livraison, si applicables, sont indiqués avant validation de la commande, sauf indication contraire.
Lors de la réception, le client doit vérifier l’état du colis. En cas de colis endommagé, ouvert ou présentant une anomalie visible, le client doit émettre les réserves nécessaires auprès du transporteur et informer White Star dans les meilleurs délais.
9. Transfert de propriété et des risques
La propriété du produit est transférée au client uniquement après paiement intégral du prix.
Le transfert des risques intervient au moment de la remise du produit au client ou à toute personne désignée par lui pour réceptionner la commande.
10. Droit de retour volontaire
White Star accorde à ses clients un droit de retour volontaire de 14 jours à compter de la réception de la commande.
Pour être accepté, le retour doit remplir les conditions suivantes :
- le client doit contacter White Star dans un délai de 14 jours suivant la réception du produit ;
- le retour doit être préalablement validé par White Star ;
- le produit doit être retourné dans son état d’origine, non ouvert, protections non retirées, non porté, non utilisé, non endommagé et complet ;
- le produit doit être retourné avec son emballage d’origine, ses accessoires, certificats, documents, étiquettes, protections et éléments fournis lors de la livraison ;
- le numéro de série, les documents d’origine et les éléments d’identification ne doivent pas avoir été altérés.
Les frais de retour sont à la charge du client, sauf erreur imputable à White Star ou défaut confirmé du produit.
White Star se réserve le droit de refuser un retour si le produit est retourné incomplet, porté, utilisé, endommagé, rayé, modifié, personnalisé ou s’il ne respecte pas les conditions de retour.
11. Produits exclus du retour
Sauf défaut confirmé ou accord écrit de White Star, les produits suivants ne peuvent pas faire l’objet d’un retour :
- produits personnalisés, gravés ou réalisés selon les spécifications du client ;
- produits portés, utilisés, rayés, endommagés ou modifiés ;
- produits dont les protections, scellés, étiquettes ou éléments d’identification ont été retirés ou altérés ;
- bracelets ajustés, modifiés ou personnalisés à la demande du client ;
- produits acquis dans le cadre d’une offre spéciale expressément exclue du droit de retour.
12. Remboursement
Après réception et contrôle du produit retourné, White Star informera le client de l’acceptation ou du refus du retour.
En cas d’acceptation, le remboursement sera effectué dans un délai raisonnable, en principe dans les 14 jours suivant la validation du retour par White Star, par le même moyen de paiement que celui utilisé lors de la commande, sauf accord contraire.
Les frais de livraison initiaux, frais de retour, frais bancaires, droits de douane, taxes d’importation ou autres frais annexes ne sont pas remboursés.
13. Garantie
White Star accorde une garantie de 24 mois à compter de la date de livraison sur les défauts de matière ou de fabrication reconnus par White Star.
La garantie couvre les défauts existant dans des conditions normales d’utilisation du produit.
Sont notamment exclus de la garantie :
- usure normale ;
- rayures, chocs, coups, traces d’utilisation ou détérioration esthétique ;
- dommages causés par accident, chute, choc, pression excessive ou mauvaise manipulation ;
- dommages causés par l’eau en cas d’utilisation non conforme à l’étanchéité indiquée ;
- utilisation inappropriée, négligence ou non-respect des recommandations d’entretien ;
- intervention, réparation, ouverture ou modification effectuée par un tiers non autorisé par White Star ;
- dommages causés au bracelet, au verre, à la couronne, à la boucle ou aux éléments soumis à usure, sauf défaut de fabrication reconnu ;
- perte, vol ou dommage causé par un tiers.
En cas de défaut couvert par la garantie, White Star pourra, à son choix, procéder à la réparation, au remplacement du produit ou au remboursement, dans les limites prévues par le droit applicable.
Toute demande de garantie doit être adressée à White Star avec une preuve d’achat, le numéro de série de la montre et une description précise du problème constaté.
14. Entretien et utilisation
Les montres White Star sont des objets horlogers nécessitant une utilisation soigneuse.
Le client s’engage à respecter les recommandations d’utilisation, d’entretien, d’étanchéité, de remontage, de réglage et de conservation communiquées par White Star.
Une utilisation non conforme peut entraîner l’exclusion totale ou partielle de la garantie.
15. Programme Pleiades, codes et avantages promotionnels
Lorsque le client utilise un identifiant personnel, un code promotionnel ou un avantage lié au programme Pleiades, les conditions spécifiques du programme s’appliquent en complément des présentes Conditions Générales de Vente.
Les réductions, avantages, codes ou offres spéciales ne sont pas automatiquement cumulables. White Star se réserve le droit de refuser l’application d’un code ou avantage en cas d’utilisation incorrecte, abusive, frauduleuse ou non conforme aux conditions applicables.
Un code ou avantage doit être indiqué avant la validation définitive de la commande et ne peut pas être exigé rétroactivement après paiement, sauf accord exceptionnel de White Star.
16. Exactitude des informations client
Le client garantit que les informations fournies lors de la commande sont exactes, complètes et à jour.
White Star ne saurait être tenue responsable des conséquences résultant d’informations incorrectes, incomplètes ou obsolètes, notamment en matière de livraison, facturation, garantie ou communication.
17. Limitation de responsabilité
Dans les limites autorisées par le droit applicable, la responsabilité de White Star est limitée au montant effectivement payé par le client pour le produit concerné.
White Star ne saurait être tenue responsable des dommages indirects, pertes commerciales, pertes de bénéfices, pertes de données, préjudices d’image, retards imputables à des tiers ou tout autre dommage ne résultant pas directement d’une faute reconnue de White Star.
Aucune disposition des présentes Conditions Générales de Vente ne limite les droits impératifs reconnus au consommateur par le droit applicable.
18. Force majeure
White Star ne saurait être tenue responsable de l’inexécution ou du retard dans l’exécution de ses obligations lorsque ceux-ci résultent d’un événement échappant raisonnablement à son contrôle.
Sont notamment considérés comme cas de force majeure : catastrophes naturelles, incendies, inondations, conflits, grèves, pandémies, décisions administratives, restrictions d’importation ou d’exportation, retards douaniers, défaillance de fournisseurs, perturbations logistiques, cyberattaques, interruptions de services ou tout autre événement imprévisible ou difficilement maîtrisable.
19. Propriété intellectuelle
La marque White Star, les logos, noms de collections, dessins, designs, photographies, textes, vidéos, éléments graphiques, contenus, produits et créations présentés sur le site sont protégés par les droits de propriété intellectuelle applicables.
Aucun élément ne peut être reproduit, utilisé, modifié, diffusé ou exploité sans l’autorisation écrite préalable de White Star.
20. Protection des données
White Star traite les données personnelles de ses clients conformément à la Loi fédérale suisse sur la protection des données et à sa politique de confidentialité. La nouvelle LPD suisse et ses ordonnances sont entrées en vigueur le 1er septembre 2023.
Les données collectées sont utilisées notamment pour le traitement des commandes, le paiement, la livraison, la gestion de la relation client, le service après-vente, la garantie, la lutte contre la fraude et, le cas échéant, les communications marketing lorsque celles-ci sont autorisées.
Le client dispose des droits prévus par la législation applicable en matière de protection des données.
21. Communications électroniques
Le client accepte que les échanges relatifs à sa commande puissent intervenir par voie électronique, notamment par e-mail.
Les confirmations de commande, factures, informations de livraison, documents de garantie ou communications relatives au service après-vente peuvent être transmis sous forme électronique.
22. Nullité partielle
Si une disposition des présentes Conditions Générales de Vente devait être déclarée nulle, invalide ou inapplicable, les autres dispositions demeureraient pleinement applicables.
La disposition concernée serait remplacée, dans la mesure du possible, par une disposition valable se rapprochant le plus possible de son objectif économique et juridique.
23. Droit applicable et for juridique
Les présentes Conditions Générales de Vente sont soumises au droit suisse.
Sous réserve des fors impératifs prévus par la loi, tout litige relatif aux présentes Conditions Générales de Vente, à une commande ou à une vente conclue avec White Star sera soumis aux tribunaux compétents du siège de White Star Watch SA.

1. Company Identification
These General Terms and Conditions of Sale govern sales concluded on the website of White Star Watch SA, a Swiss company active in the field of watchmaking and jewellery, located at Rue des Crêtets 87, 2300 La Chaux-de-Fonds, Switzerland.

Hereinafter referred to as “White Star”, “the Company”, “we” or “our”.
2. Scope of Application
These General Terms and Conditions of Sale apply exclusively to sales of White Star products concluded with final consumer clients through the official White Star website or through any other sales channel directly managed by White Star.
By placing an order, the client acknowledges having read these General Terms and Conditions of Sale and accepts them without reservation.
The applicable version is the one in force at the time the order is validated.
3. Products
The products offered for sale are described and presented with the greatest care.
Photographs, videos, 3D renderings, illustrations or visuals displayed on the website are provided for indicative purposes only. Slight differences may exist between the visuals and the product delivered, in particular due to lighting effects, screen rendering, materials, finishes, straps, textures or assembly.
The essential characteristics of the products are indicated on the relevant product pages, including the model, materials, dimensions, movement, water resistance, straps, finishes and any available options.
White Star reserves the right to make any technical or aesthetic improvements to its products, provided that such improvements do not substantially alter the essential characteristics of the product ordered.
4. Prices
Prices are indicated in Swiss francs CHF or in the local currency corresponding to the buyer’s country.
For sales delivered in Switzerland, prices include Swiss VAT where applicable.
Unless otherwise stated, prices do not include customs duties, import taxes, administrative fees, bank charges, exchange fees or any other fees applicable in the country of delivery.
For deliveries outside Switzerland, the client is solely responsible for the payment of any customs duties, import taxes, local VAT or other fees required by the authorities of the destination country.
White Star reserves the right to change its prices at any time. The applicable price is the one displayed at the time the order is validated.
5. Order
The client places an order on the White Star website by selecting the desired product or products, entering the required information and validating the payment.
Before final validation, the client must verify the accuracy of the order, including the selected model, options, delivery address, contact details and billing information.
The order becomes final after confirmation of payment and acceptance by White Star.
White Star reserves the right to refuse or cancel any order in the event of suspected fraud, obvious pricing error, product unavailability, previous dispute with the client, incomplete or incorrect information, or any other legitimate reason.
6. Payment
Payment is made using the payment methods offered on the website at the time of the order, including credit card, bank transfer or any other available payment solution.
The order will only be processed after full receipt of payment, unless otherwise agreed in writing by White Star.
In the event of payment by bank transfer, the order will only be confirmed after the funds have actually been received.
All bank charges, exchange fees or fees related to the payment method used are borne by the client.
7. Availability and Delivery Times
White Star endeavours to indicate availability and delivery times as accurately as possible.
Delivery times are provided for indicative purposes only, unless otherwise expressly agreed in writing by White Star. Certain products may require preparation, assembly, quality control or availability lead time.
White Star shall not be held liable for delays due to circumstances beyond its control, including transport delays, customs formalities, strikes, supply difficulties, logistical disruptions, health-related events, administrative decisions, force majeure events or any other event reasonably beyond its control.
8. Delivery
Products are delivered to the address indicated by the client when placing the order.
The client is responsible for the accuracy and completeness of the delivery information provided. White Star shall not be held liable for any delay, inability to deliver or additional costs resulting from an incorrect, incomplete or imprecise address.
Delivery costs, where applicable, are indicated before the order is validated, unless otherwise stated.
Upon receipt, the client must check the condition of the parcel. In the event of a damaged, opened or visibly abnormal parcel, the client must make the necessary reservations with the carrier and inform White Star as soon as possible.
9. Transfer of Ownership and Risks
Ownership of the product is transferred to the client only after full payment of the price.
The transfer of risks occurs at the time the product is handed over to the client or to any person designated by the client to receive the order.
10. Voluntary Right of Return
White Star grants its clients a voluntary right of return of 14 days from receipt of the order.
To be accepted, the return must meet the following conditions:
- the client must contact White Star within 14 days following receipt of the product;
- the return must be approved in advance by White Star;
- the product must be returned in its original condition, unopened, with protective elements not removed, unworn, unused, undamaged and complete;
- the product must be returned with its original packaging, accessories, certificates, documents, labels, protective elements and all items supplied upon delivery;
- the serial number, original documents and identification elements must not have been altered.
Return costs are borne by the client, except in the event of an error attributable to White Star or a confirmed product defect.
White Star reserves the right to refuse a return if the product is returned incomplete, worn, used, damaged, scratched, modified, personalised or if it does not comply with the return conditions.
11. Products Excluded from Return
Unless a defect is confirmed or White Star agrees otherwise in writing, the following products cannot be returned:
- personalised, engraved or custom-made products produced according to the client’s specifications;
- products that have been worn, used, scratched, damaged or modified;
- products whose protective elements, seals, labels or identification elements have been removed or altered;
- straps adjusted, modified or personalised at the client’s request;
- products purchased as part of a special offer expressly excluded from the right of return.
12. Refund
After receiving and inspecting the returned product, White Star will inform the client whether the return has been accepted or refused.
If accepted, the refund will be made within a reasonable period, in principle within 14 days following validation of the return by White Star, using the same payment method as the one used for the order, unless otherwise agreed.
Initial delivery costs, return costs, bank charges, customs duties, import taxes or any other ancillary costs are not refunded.
13. Warranty
White Star grants a 24-month warranty from the date of delivery for material or manufacturing defects recognised by White Star.
The warranty covers defects occurring under normal conditions of use of the product.
The warranty notably excludes:
- normal wear and tear;
- scratches, shocks, impacts, signs of use or aesthetic deterioration;
- damage caused by accident, fall, shock, excessive pressure or improper handling;
- water damage in the event of use not compliant with the indicated water resistance;
- improper use, negligence or failure to comply with maintenance recommendations;
- intervention, repair, opening or modification carried out by a third party not authorised by White Star;
- damage caused to the strap, crystal, crown, buckle or parts subject to wear, unless a manufacturing defect is recognised;
- loss, theft or damage caused by a third party.
In the event of a defect covered by the warranty, White Star may, at its discretion, repair the product, replace it or refund it, within the limits provided by applicable law.
Any warranty claim must be addressed to White Star with proof of purchase, the watch serial number and a precise description of the problem observed.
14. Care and Use
White Star watches are horological objects requiring careful use.
The client undertakes to follow the recommendations for use, care, water resistance, winding, setting and storage communicated by White Star.
Improper use may result in the total or partial exclusion of the warranty.
15. Pleiades Programme, Codes and Promotional Benefits
When the client uses a personal identifier, promotional code or benefit linked to the Pleiades programme, the specific terms and conditions of the programme apply in addition to these General Terms and Conditions of Sale.
Discounts, benefits, codes or special offers are not automatically cumulative. White Star reserves the right to refuse the application of a code or benefit in the event of incorrect, abusive, fraudulent or non-compliant use.
A code or benefit must be indicated before final validation of the order and may not be claimed retroactively after payment, except with the exceptional agreement of White Star.
16. Accuracy of Client Information
The client guarantees that the information provided when placing the order is accurate, complete and up to date.
White Star shall not be held liable for any consequences resulting from incorrect, incomplete or outdated information, in particular regarding delivery, billing, warranty or communication.
17. Limitation of Liability
Within the limits authorised by applicable law, White Star’s liability is limited to the amount actually paid by the client for the product concerned.
White Star shall not be held liable for indirect damages, commercial losses, loss of profit, loss of data, reputational damage, delays attributable to third parties or any other damage not directly resulting from a recognised fault of White Star.
No provision of these General Terms and Conditions of Sale limits the mandatory rights granted to consumers under applicable law.
18. Force Majeure
White Star shall not be held liable for non-performance or delay in the performance of its obligations where such non-performance or delay results from an event reasonably beyond its control.
Force majeure events include, in particular, natural disasters, fires, floods, conflicts, strikes, pandemics, administrative decisions, import or export restrictions, customs delays, supplier failures, logistical disruptions, cyberattacks, service interruptions or any other unforeseeable or difficult-to-control event.
19. Intellectual Property
The White Star brand, logos, collection names, drawings, designs, photographs, texts, videos, graphic elements, content, products and creations presented on the website are protected by applicable intellectual property rights.
No element may be reproduced, used, modified, distributed or exploited without the prior written authorisation of White Star.
20. Data Protection
White Star processes the personal data of its clients in accordance with the Swiss Federal Act on Data Protection and its privacy policy. The new Swiss Data Protection Act and its ordinances entered into force on 1 September 2023.
The data collected is used in particular for order processing, payment, delivery, customer relationship management, after-sales service, warranty, fraud prevention and, where applicable, marketing communications when authorised.
The client has the rights provided for by the applicable data protection legislation.
21. Electronic Communications
The client accepts that communications relating to their order may be made electronically, in particular by e-mail.
Order confirmations, invoices, delivery information, warranty documents or after-sales service communications may be sent electronically.
22. Partial Invalidity
If any provision of these General Terms and Conditions of Sale is declared null, invalid or unenforceable, the remaining provisions shall remain fully applicable.
The provision concerned shall be replaced, to the extent possible, by a valid provision that comes as close as possible to its economic and legal purpose.
23. Applicable Law and Jurisdiction
These General Terms and Conditions of Sale are governed by Swiss law.
Subject to any mandatory places of jurisdiction provided by law, any dispute relating to these General Terms and Conditions of Sale, to an order or to a sale concluded with White Star shall be submitted to the competent courts of the registered office of White Star Watch SA.

The horns
The lugs naturally extend the lines of the case and contribute to the overall balance of the watch. Their finishes, alternating between polished and satin-brushed surfaces, bring relief, character and elegance to the whole.
