General Terms and Conditions of Sale (GTCS) of White Star Watch SA

1. Company identification

These General Terms and Conditions of Sale govern sales concluded on the website of White Star Watch SA, a Swiss company active in the field of watchmaking and jewelry, located at Rue des Crêtets 87, 2300 La Chaux-de-Fonds, Switzerland.

Hereinafter referred to as "White Star",
"the Company", "we" or "our".

2. Champ d’application

Les présentes Conditions Générales de Vente s’appliquent exclusivement aux ventes de produits White Star conclues avec des clients finaux consommateurs, par l’intermédiaire du site internet officiel de White Star ou de tout autre canal de vente directement géré par White Star.

En passant commande, le client reconnaît avoir pris connaissance des présentes Conditions Générales de Vente et les accepter sans réserve.

La version applicable est celle en vigueur au moment de la validation de la commande.

3. Products

Products offered for sale are described and presented with the utmost care.

Photographs, videos, 3D renderings, illustrations, or visuals appearing on the site are provided for informational purposes only.

Slight differences may exist between the visuals and the delivered product, particularly due to lighting effects, screen rendering, materials, finishes, straps, textures, or assembly.

The essential characteristics of the products are indicated on the relevant pages, including the model, materials, dimensions, movement, water resistance, straps, finishes, and any available options.

White Star reserves the right to make any technical or aesthetic improvements to its products that do not substantially alter the essential characteristics of the ordered product.

4. Price

Prices are indicated in Swiss francs CHF or the local currency corresponding to the buyer's country.

For sales delivered in Switzerland, prices include Swiss VAT where applicable.

Unless otherwise stated, prices do not include customs duties, import taxes, administrative fees, bank charges, exchange fees or other fees applicable in the country of delivery.

For deliveries outside Switzerland, the customer is solely responsible for paying any customs duties, import taxes, local VAT or other charges required by the authorities of the destination country.

White Star reserves the right to change its prices at any time. The applicable price is the one displayed at the time of order confirmation.

5. Order

The customer places an order on the White Star website by selecting the desired product(s), providing the requested information, and validating the payment.

Before final validation, the customer must check the accuracy of their order, including the chosen model, options, delivery address, contact details, and billing information.

The order becomes final after payment confirmation and acceptance by White Star.

White Star reserves the right to refuse or cancel any order in case of suspected fraud, obvious pricing errors, product unavailability, previous disputes with the customer, incomplete or incorrect information, or for any other legitimate reason.

6. Payment

Le paiement s’effectue selon les moyens proposés sur le site internet au moment de la commande, notamment par carte bancaire, virement bancaire ou toute autre solution de paiement disponible.


La commande ne sera traitée qu’après réception complète du paiement, sauf accord écrit contraire de White Star.


En cas de paiement par virement bancaire, la commande ne sera confirmée qu’après réception effective des fonds.


Tous les frais bancaires, frais de change ou frais liés au moyen de paiement utilisé sont à la charge du client.

7. Availability and delivery times

White Star strives to indicate availability and delivery times as accurately as possible.


Delivery times are provided for informational purposes only, unless White Star has made a written commitment to the contrary. Some products may require a period for preparation, assembly, quality control, or making them available.


White Star cannot be held responsible for delays due to circumstances beyond its control, including but not limited to transport delays, customs formalities, strikes, supply difficulties, logistical disruptions, health events, administrative decisions, force majeure, or any other event reasonably beyond its control.

8. Delivery

Products are delivered to the address indicated by the customer when placing the order.


The customer is responsible for the accuracy and completeness of the delivery information provided. White Star cannot be held responsible for any delay, impossibility of delivery, or additional costs resulting from an erroneous, incomplete, or imprecise address.


Delivery costs, if applicable, are indicated before order confirmation, unless otherwise specified.
Upon receipt, the customer must check the condition of the package. In the event of a damaged, open, or visibly abnormal package, the customer must make the necessary reservations with the carrier and inform White Star as soon as possible.

9. Transfer of ownership and risks

Ownership of the product is transferred to the customer only after full payment of the price.


The transfer of risks occurs at the time of delivery of the product to the customer or to any person designated by them to receive the order.

10. Right of voluntary return

White Star grants its customers a 14-day voluntary return period from the date of receipt of the order.


To be accepted, returns must meet the following conditions:


• The customer must contact White Star within 14 days of receiving the product;
• The return must be pre-authorized by White Star;
• The product must be returned in its original condition, unopened, protective films intact, unworn, unused, undamaged, and complete;
• The product must be returned with its original packaging, accessories, certificates, documents, labels, protective films, and all items provided upon delivery;
• The serial number, original documents, and identification elements must not have been altered.

Return shipping costs are the responsibility of the customer, unless the error is attributable to White Star or the product has a confirmed defect.


White Star reserves the right to refuse a return if the product is returned incomplete, worn, used, damaged, scratched, modified, personalized, or if it does not meet the return conditions.

11. Products excluded from returns

Unless a defect is confirmed or agreed upon in writing by White Star, the following products cannot be returned:


• personalized, engraved, or custom-made products according to customer specifications;
• worn, used, scratched, damaged, or modified products;
• products from which protective coverings, seals, labels, or identification elements have been removed or altered;
• bracelets adjusted, modified, or personalized at the customer's request;
• products acquired as part of a special offer expressly excluded from the right of return.

12. Reimbursement

After receipt and inspection of the returned product, White Star will inform the customer whether the return is accepted or refused.


If accepted, a refund will be issued within a reasonable timeframe, generally within 14 days following White Star's validation of the return, using the same payment method as for the original order, unless otherwise agreed.


Initial shipping costs, return shipping costs, bank charges, customs duties, import taxes, or other ancillary fees are not reimbursed.

13. Warranty

White Star grants a warranty of 24 months from the date of delivery against defects in materials or workmanship recognized by White Star.


The warranty covers defects existing under normal conditions of product use.


The warranty notably excludes:


• normal wear and tear;
• scratches, impacts, dents, signs of use, or aesthetic deterioration;
• damage caused by accident, dropping, shock, excessive pressure, or improper handling;
• water damage if used in a manner inconsistent with the indicated water resistance;
• inappropriate use, negligence, or failure to follow maintenance recommendations;
• intervention, repair, opening, or modification carried out by a third party not authorized by White Star;
• damage to the strap, glass, crown, buckle, or elements subject to wear, unless a recognized manufacturing defect;
• loss, theft, or damage caused by a third party.

In the event of a defect covered by the warranty, White Star may, at its discretion, repair, replace the product, or issue a refund, within the limits provided by applicable law.


Any warranty claim must be addressed to White Star with proof of purchase, the watch's serial number, and a precise description of the problem observed.

14. Maintenance and Use

White Star watches are timepieces that require careful use.


The customer agrees to comply with the recommendations for use, maintenance, water-resistance, winding, setting, and storage provided by White Star.


Non-compliant use may result in total or partial exclusion from the warranty.

15. Pleiades Program, codes, and promotional benefits

When the customer uses a personal identifier, a promotional code or a benefit related to the Pleiades program, the specific conditions of the program apply in addition to these General Terms and Conditions of Sale.


Discounts, benefits, codes, or special offers are not automatically cumulative. White Star reserves the right to refuse the application of a code or benefit in the event of incorrect, abusive, fraudulent, or non-compliant use with the applicable conditions.


A code or benefit must be indicated before the final validation of the order and cannot be claimed retroactively after payment, except with the exceptional agreement of White Star.

16. Accuracy of customer information

The customer guarantees that the information provided when ordering is accurate, complete and up-to-date.


White Star cannot be held responsible for consequences resulting from incorrect, incomplete or outdated information, particularly concerning delivery, invoicing, warranty, or communication.

17. Limitation of liability

To the extent permitted by applicable law, White Star's liability is limited to the amount actually paid by the customer for the product concerned.


White Star shall not be liable for indirect damages, commercial losses, loss of profits, loss of data, damage to reputation, delays attributable to third parties, or any other damage not resulting directly from a recognized fault of White Star.


Nothing in these General Terms and Conditions of Sale limits the mandatory rights granted to the consumer by applicable law.

18. Force majeure

White Star cannot be held responsible for the non-performance or delay in the performance of its obligations when these result from an event reasonably beyond its control.


In particular, the following are considered force majeure: natural disasters, fires, floods, conflicts, strikes, pandemics, administrative decisions, import or export restrictions, customs delays, supplier failures, logistical disruptions, cyberattacks, service interruptions or any other unpredictable or uncontrollable event.

19. Intellectual property

The White Star brand, logos, collection names, drawings, designs, photographs, texts, videos, graphic elements, content, products, and creations presented on the site are protected by applicable intellectual property rights.


No element may be reproduced, used, modified, disseminated, or exploited without the prior written authorization of White Star.

20. Data Protection

White Star processes its customers' personal data in accordance with the Swiss Federal Data Protection Act and its privacy policy. The new Swiss DPA and its ordinances came into force on September 1, 2023.


The data collected is used, in particular, for order processing, payment, delivery, customer relationship management, after-sales service, warranty, fraud prevention and, where applicable, marketing communications when these are authorized.


The customer has the rights provided for by the applicable data protection legislation.

21. Electronic Communications

The client accepts that communications regarding their order may take place electronically, particularly by e-mail.


Order confirmations, invoices, delivery information, warranty documents, or communications related to after-sales service may be sent electronically.

22. Partial Invalidity

If any provision of these General Terms and Conditions of Sale is declared null, invalid or unenforceable, the other provisions shall remain fully applicable.


The provision in question would be replaced, as far as possible, by a valid provision as close as possible to its economic and legal objective.

23. Governing Law and Jurisdiction

These General Terms and Conditions of Sale are governed by Swiss law.
Subject to mandatory legal provisions, any dispute relating to these General Terms and Conditions of Sale, an order, or a sale concluded with White Star shall be submitted to the competent courts at the registered office of White Star Watch SA.
